BIG DUCK TOURS’ TERMS AND CONDITIONS OF USE
1. Introduction and Acceptance Terms
1.1 These terms and conditions (“Terms”) govern your use of the Big Duck Tours’ website (“Site”), and all services offered by the Big Duck Tours’ group. The Big Duck Tours’ group includes but is not limited to Big Duck Tours Limited (a company registered in England and Wales under company number 16373459, Big Bus Tours Limited (a company registered in England and Wales under
company number 07524891) with their registered office at 110 Buckingham Palace Road, London SW1W 9SA and their group companies (“Big Duck Tours, “we”, “us” or “our”).
1.2. By accessing the Site, or by making a booking for an amphibious vehicle (“Duck”) tour with Big Duck Tours, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you must not use the Site or services.

1.4. Big Duck Tours reserves the right at its sole discretion to change, modify, add to or remove portions of these terms and conditions at any time and to restrict access to any areas of the Site without notice or liability. Your continued use of the Site or booking of tours after amendments have been made constitutes your acceptance of the modified terms.
2. Terms of Service
2.1. Tickets
You must have a valid ticket to travel. Your ticket is valid only for the tour departure date and time shown at the time of booking and cannot be used for any other departure time. The customer must contact Big Duck Tours at least 24 hours in advance of the tour time to reschedule. Changes are subject to seat availability. If you do not arrive at least 15 minutes before the tour time,
the booking will be considered a no-show and these spaces may be given to other customers. In such cases, rescheduling or refunds will not be possible.
2.2. Ticket Agent
Where a ticket is purchased from one of the Big Duck Tours’ ticket agents, any query regarding the ticket purchase or refund request must be referred to the ticket agent who sold the ticket.
2.3. Children
Infant tickets are available for infants below the age of 2 years old. An infant ticket must be purchased for every infant travelling, regardless of whether a separate seat is required. Child tickets are available for children aged from 2-16 years. Children must be accompanied by an adult at all times. A maximum of 3 children may travel per accompanying adult.
2.4. Departure Points and Times
Customers must arrive 30 minutes before the departure time at the departure point.
2.5. Tour Route
Big Duck Tours endeavours to run according to schedule but may deviate from the route of a service if it considers it reasonably prudent to do so including where there is risk to passenger safety. Details of pre-planned diversions will be posted on the Big Duck Tours’ website. Any last-minute changes or cancellations will be communicated on the day by Big Duck Tours’ staff.
2.6. Safety
Prior to water entry, a member of the Big Duck Tours’ crew will conduct a mandatory safety briefing. You must remain attentive during this briefing and comply with safety instructions given by crew members at all times. Please note that customers may be required to move seats within the vehicle during the water element of the tour. Big Duck Tours reserves the right to require passengers to wear personal flotation devices for the duration of the water borne portion of the tour. For safety reasons, passengers must remain seated and keep all limbs inside the vehicle while the Duck is in motion whether on land or in water. For your own safety and the safety of others, Big Duck Tours reserves the right to refuse access to travel on a particular departure should circumstances be deemed to compromise tour safety.
2.7. Accessibility
To board Big Duck Tours, you need to be able to climb the seven entry steps. The stairway is wide enough for one person and fitted with handrails on both sides. Please note – the Ducks are not wheelchair accessible. 2.8. Pricing and promotional offers
Prices relating to the Services can be found on the relevant pricing page of the Site. All prices are inclusive of applicable local taxes. Big Duck Tours reserves the right to alter the prices of any services immediately and without notice. Big Duck Tours may from time to time offer discounts or promotional offers, with or without a discount or promotional code. Discounts with codes are usually only valid for one transaction and, once the code is used, it will be deactivated and will no longer be valid. Big Duck Tours does not bear any responsibility or liability for discounts or promotional offers published on external websites and reserves the right to withdraw any discounts and promotional offers at any time without notice.
2.9. Cancellation and Refunds
In the event that Big Duck Tours is unable to provide part or all services during the period of validity of your ticket through circumstances within its control, you shall be entitled to a partial or full refund of the price of your ticket. Please scan and attach your ticket to your email. Big Duck Tours shall not be in breach of these terms and conditions, nor shall it be liable, for delay in performing, or failure to perform, any of the services if such delay or failure results from events, circumstances or causes beyond its reasonable control or due to your breach or non-compliance.
2.10. Prohibited Conduct
Entry may be refused if your actions or behaviours are likely to impact the safety or enjoyment of others. The following conduct is strictly prohibited on board: consumption of food and drink (except bottled water), consumption of alcohol or non-prescription drugs, smoking, vaping or e-cigarettes, disruptive, abusive or threatening behaviour, leaning over railings or attempting to touch the water, or throwing objects overboard.
2.11. Limitation of liability
To the extent permitted by law, Big Duck Tours’ total liability to you for any claim arising from or relating to the services or the Site shall not exceed the total price paid by you for the tour. Big Duck Tours shall not be liable for: https://www.bigducktours.com/en/singapore/contact-us
- Indirect, incidental, special or punitive damages (including loss of profit, loss of data or loss of enjoyment);
- Delays, cancellations or changes to tours due to circumstances beyond Big Duck Tours’ reasonable control; or
- Loss or damage to personal belongings.
2.12. Exceptions to limitation of liability
Notwithstanding clause 2.11, Big Duck Tours shall not limit or exclude liability for death or personal injury caused by Big Duck Tours’s negligence, fraud or fraudulent misrepresentation, breach of statutory rights under mandatory consumer protection laws.
2.13. Insurance
Proof of public liability, road and river insurance can be requested.
3. Use of Site
3.1. Acceptable Use
You must not use the Site for any unlawful, improper or illegal purpose or activity. You are prohibited from using the Site in a way which causes or may cause:
- Damage to the reputation of Big Duck Tours;
- Any of the Site or services offered through the Site to be interrupted, damaged or impaired;
- A virus or malicious code to be introduced to any part of the Site;

Offense or detriment to any other person who uses the Site;
You are prohibited from:
- Transmitting obscene or offensive content;
- Deliberately attempting to overload or "crash" the Site;
- Attempting to gain unauthorized access to the Site or Big Duck Tours’ systems;
- Collecting or tracking personal information of others without consent;
- Spamming, phishing, or conducting any form of fraud;
- modifying, translating, decomposing, decompiling, reverse engineering, disassembling or otherwise attempting to gain access to the source code of all or
any part of any Platform; - creating derivative works from any part of any Platform; or
- copying any part of any Platform (including any related documentation) or making commercial use of, leasing, charging, selling, publishing, sub-licensing distributing, assigning or otherwise transferring any part of any Platform.
3.2 Uploading content
Whenever you make use of a feature that allows you to upload content to the Site, or to make contact with other users of the Site, you must comply with the content standards set out above in the “Acceptable Use” section. You warrant that any such contribution does comply with those standards, and you will be liable to Big Duck Tours for any breach of that warranty. Any content you upload to the Site will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you are required to grant Big Duck Tours a limited licence to use, store and copy that content and to distribute and make it available to third parties. As such, you grant to Big Duck Tours a perpetual, worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of and display your content in connection with the Services across different media, including the Site. Big Duck Tours also has the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to this website constitutes a violation of their intellectual property rights, or of their right to privacy. Big Duck Tours will not be responsible, or liable to any third party, for the content or accuracy of any content posted by you or any other user of the Site. Big Duck Tours has the right to remove any posting you make on the Site if, in its opinion, your post does not comply with the content standards set out above in the “Acceptable Use” section. The views expressed by other users on the Site do not represent Big Duck Tours’ views or values. You are solely responsible for securing and backing up your content.
3.3. Intellectual Property Rights
Unless otherwise stated, all intellectual property on the Site (including the screen displays, the content, the text, graphics look and feel of any of the Site) belongs to Big Duck Tours or its licensors. All trademarks, service marks, company names or logos are the property of their respective holders. Big Duck Tours does not warrant that the Site do not infringe any intellectual property rights of third parties. You may not reproduce, distribute, transmit, or exploit any content without Big Duck Tours' prior written consent. Your use of any intellectual property displayed on or relating to the Site, except as provided in these terms and conditions, is strictly prohibited. Big Duck Tours will aggressively enforce its intellectual property rights to the fullest extent of the law. Nothing relating to the Site should be construed as granting any licence or right in or to any trademarks, service marks or trade dress of Big Duck Tours or any other intellectual property owned by any member of Big Duck Tours’ group.
3.4. Third Party Sites
Big Duck Tours is not responsible for the content of any other sites that are linked to or from any of the Site and Big Duck Tours excludes all warranties and all liability for any loss or damage you incur as a result of your use of such sites.
3.5. Linking Conditions for Site
You may not link to any applicable Site unless you have obtained the prior written consent of Big Duck Tours. If you have obtained consent, you must comply with the following conditions:
- you must only link to the homepage of this website (http://www.bigducktours.com/). Linking to other content within the relevant Platform is prohibited without Big Duck Tours’ express written permission; the text of the link must read either "Big Duck Tours" or “www.BigDuckTours.com”.
- You may not use any Big Duck Tours logo or graphic as part of the link without Big Duck Tours’ prior written consent;
- the link and surrounding content on the linking site must not: (a) falsely represent or misrepresent any relationship between the linking site and Big Duck Tours; (b) portray Big Duck Tours, or its products or services, in a false, misleading, derogatory or otherwise offensive manner, or in a way which damages or is likely to damage the reputation of Big Duck Tours; or (c) alter the layout, content, look or feel of the relevant Platform; and

4. Boilerplate
4.1. Entire Agreement
These Terms, together with the Privacy Notice and any other documents referenced herein, constitute the entire agreement between you and Big Duck Tours regarding your use of the Site and services. These Terms supersede all prior negotiation representations, and agreements, whether written or oral.
4.2. Severability
If any provision of these Terms is found to be invalid, unenforceable, or illegal by a court of competent jurisdiction, that provision will be severed and the remaining provisions will continue in full force and effect. If necessary, Big Duck Tours will modify the invalid provision to make it enforceable while preserving the original intent.
4.3. Waiver
The failure of Big Duck Tours to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Big Duck Tours' waiver of any breach does not constitute a waiver of any subsequent breach.
4.4. Priority of Laws
In the event that any part of these terms and conditions at any time conflicts with the laws of a jurisdiction in which you use the Services or the Site, the laws of that jurisdiction shall prevail but only to the extent of such conflict.
4.5. Governing Law
These terms and conditions are governed by the laws of England and Wales and you agree that the English courts shall have exclusive jurisdiction in any dispute.
